These Terms of Service ("Terms") govern your access to and use of michaeldmarkham.com (the "Site") operated by Michael D. Markham ("we," "us," or "our"). By using the Site, you agree to these Terms.

Use of the Site

The Site and its content are provided for informational purposes about our SEO consulting services. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party.

Intellectual property

All content on the Site — including text, graphics, logos, and design — is owned by Michael D. Markham or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without prior written permission.

No warranty

The Site and all content on it are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Any SEO guidance, articles, or tools on the Site are provided for general informational purposes only and do not constitute a guarantee of any specific search-engine ranking, traffic, or business outcome.

Limitation of liability

To the fullest extent permitted by law, in no event will Michael D. Markham, or any of its affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site.

Services engagements

Any consulting or professional services provided by Michael D. Markham are governed by a separate written engagement agreement between you and us. In the event of a conflict between these Terms and such an agreement, the engagement agreement controls with respect to the services described in it.

SMS/text messaging terms

If you provide a mobile phone number and consent to SMS communications through a form on the Site, you may receive text messages from Michael D. Markham related to your inquiry and ongoing customer care, including responses to questions you submit, scheduling and follow-up regarding a proposal or engagement, and service-related updates. This is not a marketing or promotional SMS program.

Opt-out. You can opt out of SMS communications at any time by replying STOP to any message you receive from us. Reply HELP for help. After you reply STOP, we will send one confirmation message and will not send you further SMS messages unless you opt back in.

Message frequency and cost. Message frequency varies based on your interaction with us. Message and data rates may apply depending on your mobile carrier and plan. You are responsible for any charges from your carrier.

Carrier disclaimer. Mobile carriers are not liable for delayed or undelivered messages.

Age restriction. You must be at least 18 years of age to consent to receive SMS messages from us. By providing your mobile number and consenting to SMS communications, you represent that you are 18 or older.

Consent is not a condition of purchase. Providing consent to receive SMS messages is not required to purchase any goods or services from us.

Information collected through SMS communications is handled in accordance with our Privacy Policy.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of those courts.

Changes

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
